Terms of Service

1. Acceptance of these terms

These Terms of Service (the "Terms") are an agreement between you and JuxBox Inc. ("JuxBox", "we", "us", or "our"), the operator of the Blinks website, web app, and mobile apps (together, the "Service"). By creating an account or using the Service you agree to these Terms.

You must be at least 18 years old to use the Service. If you don't meet that age, or you don't agree to these Terms, please don't use the Service.

2. What Blinks is

Blinks is a social app for golfers. It helps you discover other players, set up rounds with friends and groups, and search for tee times at golf courses. Blinks does not book tee times for you — when you're ready to play, you book directly with the course on its own booking system.

3. Your account

• Keep the information on your profile accurate and up to date.
• Keep your password and login credentials confidential. You're responsible for everything that happens under your account.
• One account per person. Don't sign up on behalf of someone else without their permission.
• Tell us as soon as possible if you suspect your account has been compromised — email legal@blinks.golf.

4. Acceptable use

When you use the Service, you agree not to:

• Harass, threaten, bully, or harm other users.
• Impersonate another person or misrepresent your identity, skill level, or handicap in a way that's intended to mislead other users.
• Post content that is illegal, hateful, sexually explicit, infringing, or otherwise objectionable.
• Use the Service to send spam, advertising, or unsolicited messages.
• Attempt to access another user's account, scrape data from the Service, reverse-engineer our apps, or interfere with the operation of the Service.
• Use the Service to make fraudulent bookings, no-show repeatedly, or otherwise abuse courses listed on Blinks.
• Use the Service in violation of applicable law.

We may remove content, suspend accounts, or terminate access at our discretion when we believe these rules have been broken. See section 10.

5. Content you post

You keep ownership of the content you post on the Service — profile information, group descriptions, round notes, and similar. By posting it you grant JuxBox a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content for the purpose of operating and improving the Service.

You're responsible for what you post. By posting content you confirm you have the rights to share it and that it doesn't infringe anyone else's rights or violate applicable law.

6. Tee time bookings

Blinks helps you discover tee times listed by golf courses and coordinate rounds with other players. When you're ready to book, you complete the booking directly with the course on its own booking system — Blinks does not book on your behalf or process any payment. The booking is a contract between you and the course, not between you and JuxBox. The course is responsible for honouring the booking, setting cancellation and refund policies, and providing the round itself.

We do our best to keep tee time availability, course information, and pricing accurate, but we don't guarantee it. Times shown in Blinks may be out of date, may be unavailable by the time you confirm, or may differ from what the course charges at the tee.

7. Pricing

The Service is currently free for golfers. We don't charge you to sign up, search for players, browse tee times, create groups, or use any feature in the app.

We may introduce optional paid features in the future. If we do, we'll tell you what the fees are and give you a chance to opt in before charging you. Any tee time green fees charged by a course at the time of booking are between you and that course.

8. Intellectual property

The Blinks name, the JuxBox name, our logos, and the software, design, and content of the Service are owned by JuxBox or its licensors. We grant you a personal, non-transferable, non-exclusive licence to use the Service in accordance with these Terms. Nothing in these Terms transfers any of our intellectual property rights to you.

9. Third-party services

The Service depends on services we don't control, including (without limitation) Amazon Web Services, Amazon Cognito, Google Firebase Cloud Messaging, Postmark, and Google Places.

We aren't responsible for outages, errors, or losses caused by these third parties. Their own terms and privacy policies may apply when you use features that integrate with them.

10. Suspension and termination

We may suspend or terminate your account at any time if we reasonably believe you've broken these Terms, are using the Service fraudulently, or are putting other users or the Service at risk. Where practical we'll give you notice and a chance to fix the issue first.

You can delete your account at any time through the app or by emailing legal@blinks.golf.

After termination, our Privacy Policy governs how we handle the data we held about you. Sections of these Terms that by their nature should survive termination (for example sections 5, 8, 11, and 12) will continue to apply.

11. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. To the maximum extent permitted by law, JuxBox disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement.

We don't guarantee that the Service will be uninterrupted, error-free, or secure; that tee times shown will be available or accurate; that you'll find playing partners; or that you'll have a particular experience on any round you book.

12. Limitation of liability

To the maximum extent permitted by law, JuxBox's total aggregate liability arising out of or relating to these Terms or your use of the Service is limited to CAD $100. JuxBox will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, goodwill, data, or other intangible losses.

Nothing in these Terms excludes liability that cannot be excluded by law — including liability for fraud, gross negligence, or willful misconduct.

13. Changes to these terms

We may update these Terms from time to time. When we do, we'll revise the "Last updated" date at the top of this page. If the changes are material we'll notify you by email or in-app before they take effect. Your continued use of the Service after changes take effect means you accept the updated Terms.
